1. Agreement to Terms
By subscribing to and using the BirdFluZone notification service ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use the Service.
The Service is operated by Oarsman Software Ltd, a company registered in England and Wales (Company Number: 16652196) with registered office at Unit 82a James Carter Road, Mildenhall, Bury St. Edmunds, England, IP28 7DE.
2. Description of Service
BirdFluZone is a notification service that alerts subscribers when High Pathogenicity Avian Influenza (HPAI) cases are confirmed or closed near their registered flock location(s). The Service:
- Monitors publicly available government data on HPAI outbreaks in England
- Checks for new cases and case closures approximately every 15 minutes
- Sends notifications via email and SMS when cases are detected within proximity to your registered flock location(s)
- Provides information about applicable disease control zones and biosecurity requirements
The Service is designed to help poultry keepers stay informed about HPAI risks near their flocks and make informed decisions about housing and biosecurity measures.
3. Eligibility
You must be at least 16 years of age to subscribe to and use the Service. By subscribing, you confirm that you meet this age requirement.
4. Subscription and Pricing
4.1 Subscription Options
The Service is available on the following subscription basis:
- Monthly subscription: £4.99 per month, includes monitoring of up to 2 flock locations
- Annual subscription: £39.99 per year, includes monitoring of up to 2 flock locations
- Additional locations: Coming soon
4.2 Payment
All payments are processed securely through Stripe. By subscribing, you authorize us to charge your selected payment method on a recurring basis according to your chosen subscription plan.
Prices are in British Pounds (GBP) and include VAT where applicable.
4.3 Billing
- Monthly subscriptions are billed on the same day each month
- Annual subscriptions are billed once per year on the anniversary of your subscription date
4.4 Failed Payments
If a payment fails, Stripe will automatically attempt to retry the payment over a period of up to 3 days. If payment is not successful after these retry attempts, your subscription will be terminated and your data will be deleted as per our Privacy Policy.
You will be notified by email if a payment fails so you can update your payment method.
5. Cancellation and Refunds
5.1 Cancellation
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing period. You will continue to receive notifications until the end of the paid period.
5.2 No Refunds
Important: All subscription fees are non-refundable. The Service processes data for all subscribers continuously, checking for relevant cases every 15 minutes from the moment you subscribe. We do not offer refunds for:
- Periods where no HPAI cases were detected near your location(s)
- Unused portions of monthly or annual subscriptions
- Dissatisfaction with the Service (you may cancel at any time to avoid future charges)
- Technical issues or service interruptions (see Section 7 for limitations of liability)
We reserve the right to issue refunds at our sole discretion in exceptional circumstances.
6. Service Performance and Availability
6.1 Target Performance
We aim to send notifications within 12 hours of HPAI case information being published by UK government sources. In most circumstances, notifications are sent within 30 minutes of publication.
6.2 No Guarantee of Performance
The Service is provided on a "best efforts" basis. We do not guarantee:
- 100% uptime or availability of the Service
- Specific notification delivery times
- Completeness or accuracy of government data
- That all relevant HPAI cases will be detected and notified
6.3 Data Sources
The Service relies on publicly available data published by UK government agencies including the Animal and Plant Health Agency (APHA). We process and interpret this data to the best of our ability, but we cannot guarantee its accuracy, completeness, or timeliness.
7. Limitations of Liability
CRITICAL NOTICE - PLEASE READ CAREFULLY:
7.1 Not a Substitute for Official Guidance
The Service is an informational tool only. It is NOT a substitute for:
- Official government guidance and regulations
- Your legal obligations as a poultry keeper
- Professional veterinary or biosecurity advice
- Regular monitoring of official APHA/DEFRA communications
7.2 Your Responsibility
You remain solely responsible for:
- Complying with all applicable laws and regulations regarding avian influenza control measures
- Making decisions about housing, biosecurity, and flock management
- Verifying information with official sources
- Checking official government maps and guidance regularly
- Understanding and following all requirements within disease control zones
7.3 No Liability for Losses
To the fullest extent permitted by law, Oarsman Software Ltd shall not be liable for any losses, damages, or consequences arising from:
- Failure to receive notifications
- Delayed or inaccurate notifications
- Technical failures or service interruptions
- Inaccuracies in government data sources
- Your reliance on the Service
- Actions or decisions you make based on notifications received
- Non-compliance with legal requirements
- Loss of livestock, financial losses, or any other consequential damages
7.4 Maximum Liability
In any event, our total liability to you for any claims arising out of or related to the Service shall not exceed the total amount you have paid us in the 12 months preceding the claim.
8. Your Obligations
8.1 Accurate Information
You must provide accurate flock location information. You are responsible for updating your flock locations if they change.
8.2 Account Security
You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
8.3 Prohibited Uses
You must not:
- Resell, redistribute, or commercially exploit the notifications or data provided by the Service
- Use the Service for any unlawful purpose
- Attempt to reverse engineer, scrape, or access the Service through automated means other than the intended user interface
- Interfere with or disrupt the Service or servers
- Provide false or misleading information
- Share your account credentials with others
9. Termination
9.1 Termination by You
You may terminate your subscription at any time as described in Section 5.1.
9.2 Termination by Us
We reserve the right to suspend or terminate your account immediately if:
- Payment fails and is not resolved after Stripe's automatic retry attempts
- You breach these Terms and Conditions
- You use the Service for prohibited purposes
- We are required to do so by law
- We cease providing the Service entirely (with reasonable notice)
9.3 Effect of Termination
Upon termination of your subscription:
- You will immediately lose access to the Service
- Your personal data will be immediately and permanently deleted from our systems as described in our Privacy Policy
- No refund will be provided for any unused portion of your subscription
- Sections 5.2, 7, 11, and 12 of these Terms shall survive termination
10. Geographic Scope
The Service currently monitors HPAI cases in England only. While you may register flock locations anywhere, we can only provide notifications for cases detected in England at this time.
We may expand coverage to Scotland, Wales, and Northern Ireland in the future. If we expand coverage to additional regions, existing subscribers with registered flock locations in those regions will begin receiving notifications for those areas at no additional charge for as long as the Service operates.
11. Intellectual Property
All content, features, and functionality of the Service, including but not limited to the website, software, algorithms, data processing methods, and user interface, are owned by Oarsman Software Ltd and are protected by copyright, trademark, and other intellectual property laws.
The underlying government HPAI data is publicly available and remains the property of the UK government. Our value is in the processing, monitoring, and timely delivery of relevant notifications.
12. Changes to Terms
We may modify these Terms and Conditions at any time. If we make material changes, we will notify you via email at least 30 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised terms.
If you do not agree to the revised terms, you may cancel your subscription before the changes take effect.
13. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. Please review our Privacy Policy carefully.
14. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising from these terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Nothing in these Terms and Conditions affects your statutory rights as a consumer under UK law, including those provided by the Consumer Rights Act 2015.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Oarsman Software Ltd regarding the Service and supersede any prior agreements.
